This policy describes the actual processing performed by the public platform and operator portal under the Swiss FADP and, where applicable, the GDPR.
1. Controller
Jürgen Walter, Lindachstrasse 13, CH-3038 Kirchlindach, Switzerland, email: info@nightski.app, is responsible for NightSki's processing. Polar is independently responsible for checkout and payment data under its Buyer Terms.
2. Data we process
Depending on how you use the service, we process account and contact data, organisation and role details, destinations and uploaded content, contract and licence status, support messages, link statistics, and technical log, device, security and consent data.
3. Purposes and legal bases
We process data to provide and secure the platform, authenticate users, perform contracts, synchronise billing, publish operator content, provide support, prevent abuse, diagnose errors and—where consent is required—provide analytics or advertising. Legal bases are contract and pre-contractual steps, legal obligations, legitimate interests and consent.
4. Service providers
We use specialised processors and platform providers. They receive only the data required for their task.
- Clerk for login, accounts and sessions
- Convex for database, file storage, backend functions and logs
- Vercel for hosting, delivery, technical analytics and AI Gateway
- Polar as Merchant of Record for checkout, subscriptions, taxes, invoices and refunds
- Resend for transactional email and Google for consent-based analytics and advertising
5. Payments and Polar
Payment and invoice details are collected directly by Polar and its payment processors. NightSki does not store full card details; it stores only the customer, product, order, subscription and status references required to grant and audit access.
6. Cookies, analytics and advertising
Necessary cookies and storage support login, security, language and consent management. Vercel Analytics, Google Analytics or Google AdSense are used only in line with the selected consent. Consent can be changed at any time in cookie settings.
7. Source monitoring and AI
Source monitoring stores publicly available content from official destination websites and sends it through Vercel AI Gateway to the configured model. Account, payment and private customer data are not intended to be sent. Results are suggestions, are logged and are reviewed before publication.
8. Retention, security and international transfers
We retain data only as long as required for accounts, contracts, publication, security, evidence and statutory retention. Deletion may be delayed for backups and mandatory billing records. Providers may process data in Switzerland, the EEA and the United States using applicable adequacy decisions, Data Privacy Frameworks or standard contractual clauses.
9. Rights, contact and changes
Where applicable, individuals may request access, correction, deletion, restriction, portability or objection and may withdraw consent. Complaints may be made to the competent data-protection authority. Send requests to info@nightski.app. We update this policy when our processing materially changes.
